To sponsor a non-EEA national to work in your UK business, you must hold a Sponsorship Licence. The job offered must also pay the appropriate salary and be sufficiently skilled to meet the Tier 2 General criteria.
You are normally required to show that you cannot find a suitable person from within the UK first – a process known as the resident labour market test. This is not required if the role is a Tier 2 Shortage Occupation .
